Fort Bend has been one of the fastest-growing counties in Texas for years, and a lot of that growth has landed on land that is not inside any city. For anyone installing pallet racking, that matters more than it sounds. A warehouse with a Fulshear or Richmond address may answer to a city fire marshal, or to the Fort Bend County Fire Marshal under a county code with its own thresholds. The rack drawings can be identical and the permit path still different.
The Starting Point: Texas Leaves It Local
Texas does not run a statewide commercial building-code enforcement office. Cities adopt and enforce their own building and fire codes. Counties have narrower authority: state law lets qualifying counties adopt a fire code that applies to commercial buildings, public buildings and larger multifamily buildings in unincorporated areas. Fort Bend County has done exactly that, which gives the county two very different regimes sitting side by side.
Inside City Limits
Sugar Land, Missouri City, Richmond and Fulshear are incorporated cities. Inside each one, the city handles building permits and fire code review for a rack project, under whichever code editions and local amendments that city has adopted. Sugar Land and Missouri City both have established industrial and flex space; Richmond, the county seat, has older commercial stock near downtown alongside newer development on its edges; Fulshear is mostly new construction.
Two things catch people inside the cities:
- Missouri City spans two counties. Part of the city lies in Harris County. The city still reviews work within its limits, but anything unincorporated nearby could be Harris County rather than Fort Bend, with a different county fire code.
- City editions differ. Each city chooses its own code edition and amendments. A threshold that applied to a job in Sugar Land last year is not automatically the rule in Richmond this year. Ask the office for its current adopted codes before the engineer starts.
Outside City Limits: The Fort Bend County Fire Code
The Fort Bend County Fire Code, Eighth Edition, was adopted by Commissioners Court and took effect on October 1, 2023. It adopts the 2021 International Fire Code with county amendments and applies in the unincorporated areas of the county. The county Fire Marshal's Office administers it. Several provisions bear directly on rack.
Construction permit for commercial work
The county code requires a construction permit before construction or substantial improvement of a commercial building in the unincorporated area, and it defines substantial improvement broadly enough to include a change in occupancy classification. A warehouse fit-out that brings in a new rack system is squarely the kind of project the Fire Marshal's Office expects to see.
High-piled storage operational permit
The county code carries the IFC operational permit for high-piled storage: a permit is required to use a building or portion of one with more than 500 square feet, including aisles, of high-piled storage, and the permit is renewed annually. Five hundred square feet including aisles is a small area. Two short rows of rack with an aisle between them can pass it.
High-piled storage generally means combustible storage over 12 feet high, or over 6 feet for high-hazard commodities such as Group A plastics. If you are unsure whether your product qualifies, classify it before the layout is drawn. The answer changes sprinkler requirements and flue spacing as well as the permit.
A sprinkler amendment worth knowing
Fort Bend County amended the IFC sprinkler provisions to require an automatic sprinkler system throughout buildings with a building area greater than 6,000 square feet, and in existing buildings enlarged past that size. That is a much lower threshold than many people expect. If a project is expanding a small building to make room for rack, confirm early what the enlargement triggers.
Check the current text. We quote the Eighth Edition as published by the county. Codes are amended; before you rely on any threshold here, confirm the current edition with the Fort Bend County Fire Marshal's Office for your parcel.
The ETJ Trap
Growing cities in Fort Bend have large extraterritorial jurisdictions: land outside city limits that the city can regulate in limited ways, mostly around subdivision and platting. An ETJ is still unincorporated, so a city's fire code generally does not follow you into it. That is where the mailing-address problem bites hardest. A warehouse can carry a Fulshear or Richmond address, sit in the city's ETJ, and fall under the county fire code for the rack. The same is true of utility districts and master-planned communities, which provide services but do not issue building permits.
The fix is simple and cheap: check the parcel against the city limits map and the appraisal district record before anyone designs anything. If the answer is unclear, call the city first and ask whether the address is inside the limits.
What Goes in the Submittal
Whichever office reviews it, a rack submittal in Fort Bend looks broadly the same:
- Sealed drawings. Layout, elevations, beam and upright specifications, load calculations and anchorage, sealed by an engineer licensed in Texas.
- Commodity description. What will be stored, how it is packaged and its classification.
- Storage layout. Rack locations, aisle widths, storage heights and the high-piled area including aisles.
- Sprinkler information. Whether the existing system protects the proposed commodity at the proposed height.
- Fire department access. Access doors and egress paths through the storage area.
Submit the building and fire reviews together where they are separate, so they run in parallel. We do not publish review times for these offices; ask the reviewing office for its current turnaround and plan the schedule from that.
Two Local Conditions for the Engineer
Clay slabs. Sugar Land and Missouri City sit on some of the most expansive clay in the Houston area. Floors move with wet and dry seasons, which affects anchorage and can pull frames out of plumb over time. Anchor design should start from the actual slab, cored where drawings are missing.
Post-tensioned floors. Some newer buildings along the Grand Parkway and US 59/I-69 are built on post-tensioned slabs, and you should not assume either way. Where tendons are present they must be located before drilling; a cut tendon is a structural repair and a safety incident.
Don’t Forget the Annual Renewal
Under the county code the high-piled operational permit is renewed every year. Put it on the calendar the day the permit is issued, keep a copy of the approved storage layout with it, and treat any change to aisles or rack layout as a reason to call the Fire Marshal’s Office before the change, not after.
